Incident Description

This event occurred westbound, just outside the Woodside Town limits, on Hwy 84 (near Alice's Restaurant).

It happened at about 10:30 am on Monday November 16 (the time stamps on both cameras are inaccurate).

I was starting out from the Alice's parking lot and my friend Jeff Poetsch was behind me. I heard a truck aggressively approaching behind me and saw in my mirror that the truck was not pulling out to pass me at a safe distance so I pulled to the right onto the shoulder which was littered with debris and had a sign protruding into the space above it. This is a hazardous maneuver because the debris could cause a fall which might propel me into the traffic lane.

The truck passed me with about one foot of clearance and upon reviewing my videos I see that it passed even closer to Jeff.

Unfortunately the truck did not have a front plate and I cannot make out the plate number on images of the rear plate. The truck does have a distinctive grill guard, and other modifications. I think it was a white heavy duty Dodge Pickup.

The truck overtook crossing double yellow lines and on a blind corner and with a cyclist was coming downhill. The driver passed us and then slower down and then verbally assaulted us. Given what he had said I was afraid he was going to take retalatory action.

Frank Masterson was killed while descending KIngs Mountain Road, the same road:

"The cycling community lost one of its own yesterday. Frank Masterson,

I was riding eastbound on 26th St between Dolores St and Guerrero St at approximately 20mph when a grey Honda Accord (licence plate CA 8LVC168) driven by a male, light-skinned, dark hair, approximately 40 years old, passed me in the oncoming traffic lane at a high rate of speed (35+ mph). I yelled at the driver to slow down. He stopped his car in front of me, in the middle of the block, and began yelling. I stopped my bike behind his car. When he didn't move after approximately 5 seconds, I continued past his stopped car, through the intersection of 26th St and Guerrero St. The car caught up to me again, passed me, and then veered into my path in an attempt to hit me. I stopped my bike and called 911. The vehicle continued eastbound on 26th St.

San Bruno Police Incident Report # 2006230107 – Permanent Record #20000130

My name is Glenn Kirby. On Tuesday, June 23, 2020 at approximately 11:00 am John Barclay and I were riding our bicycles west on Sneath Lane. We left the trail by the BART station and were approaching El Camino Real with me in the lead and John following. I observed from the painted arrow in the lane that it would become a right-turn only lane, so I began to slowly, but deliberately move to the left toward the lane that continued through the intersection. I had a small mirror on my eyeglasses that I used to check behind me. I saw John about 50 or 60 feet behind and I noticed a US Postal Service truck in the travel lane further to the left. I did not see any other vehicles. I had a video camera on the back of the bike recording the ride. I was clearly in the lane moving at about 8 or 10 miles per hour when without warning a Dodge Dakota pickup truck with CA License number 8C73189 came up behind me, encroached into my right-of-way in a reckless manner causing the truck mirror on the passenger side to strike my shoulder. I had no advance warning. The driver honked his horn at the same time that I was struck and nearly knocked off of the bike. I was quite stunned and alarmed, but I recovered my balance and caught up with the truck as it stopped at the traffic signal, preparing to turn north on El Camino. I approached the truck on the driver’s side, the window was down and I observed a white male individual approximately 60 years of age with glasses, gray hair and a long, bushy gray beard. He was alone in the truck. After the assault, I was agitated as John and I tried to tell the driver that he was in the wrong and that we had the right of way in the lane. I have a hearing loss and, although I wear hearing aids, I had trouble understanding the driver’s response, although it seemed to me that he was saying that we, and bikes in general, should not be in the lane. It became a brief shouting match and after a few seconds the driver turned right, drove away, leaving the scene.

Fortunately, across El Camino waiting at the traffic signal was Officer Jimenez, who I do not think saw the collision, but she did see us talking to the driver and saw him drive away. She pulled over to ask us if we were OK. After we briefly explained what had happened, she asked me if I was willing to press charges and I responded yes, she then turned on her red lights and headed north to look for the truck. She also called her partner to respond, and shortly Officer Perencin arrived on his motorcycle. Also, the driver of the US Postal truck that was in the adjacent lane stopped to say that if we needed a witness he was willing to give his name and phone number, which we recorded. Mario Gomez – (650) 636 5754. Officer Perencin began his investigation by questioning us separately. I told him about the postal worker witness and also that I had a video camera turned on at the rear of my bike. He said that I could give him a copy of the video and I responded that the video was on a memory card. He said that since the police station was just two blocks away next to BART we could follow him there and he could try to look at the camera’s recording. We met him at the front of the station where I gave him the memory card from the camera. He went into the station and after a short while came out to report that he had opened the video file and observed the truck passing John, giving him clearance, and then approaching me. He said that he could not read the license plate. He pointed out that the date and time stamp was not properly set in the camera and advised that I correct the setting, which I acknowledged. He returned the memory card and said that since there was no injury or property damage California law prevented him from taking further action but that he had opened an Incident Report and he gave me a card with the report number. After returning home I opened the video file on my computer. The incident begins at 4:39 of the 10-minute file. I can see the point where the bike lane ended and I started to move into the travel lane toward the left of the lane. Behind me is John and I can see the postal truck in the lane to the left. After I have moved into the lane the video shows the pickup overtaking John and also coming alongside the postal truck before moving into my path and striking me. The video continues and although the images are toward the rear of the bike when we were talking to the driver, the audio was good enough to understand part of the exchange. I am including two images captured from the video showing the pickup and the license plate and also the point at which he honked his horn and struck me.

Given the video recording identifying the truck, our description of the driver, and the postal driver’s willingness to provide a witness statement, I am requesting that the police contact the driver and cite him for assault and battery, encroaching into my right-of-way, failing to give three feet of clearance for safe passing and for leaving the scene.

I was very pleased with the response by both Officer Jimenez and Officer Perencin. They both were very professional and responsive to us following the incident. Officer Perensin, in particular, took the extra step to view my video file at the police station. I believe this driver was reckless, did not understand that bicycles have legal rights on streets in California and that he should be contacted and cited before he assaults and injures another cyclist.

(This is the description that I originally composed to submit to the San Bruno PD Incident Report, however the online form only permitted up to 2000 Characters. Below is the PDF of the actual report with my edited text.

On Wednesday, June 24 Officer Perencin called me. He remains unwilling to proceed with an investigation. He asked what I wanted and I said that this individual needed to be contacted and cited and that he was a danger to others. At the end of the call he said that he would talk to his supervisors. But, he questioned whether I was legally in the lane, made a distinction between Battery and a Collision where there was no intent or injury and did not know about the 3-foot law. When he looked it up he responded that he could not cite for an infraction that he did not witness. I responded that how the could an infraction otherwise be enforced? We have video and two witnesses. I asked him to take this upstairs and get back to me, and that I would be working with CycistVideoEvidence on how to proceed.

A short while later Officer Perencin called me back to further clarify his position on this incident. He again stated that according to the CHP Investigation Manual there was no collision. There was no crime since there was no intent leading to the assault. He could not cite for an infraction that he had not witnessed and said that if I had been knocked off my bike and there was a collision per his definition the infraction could be included by not in this case. He explained that citations were arrests and that he could cite or arrest for felonies and misdemeanors but did not see his authority extending to infractions. He uses Section 21706 of the CA Vehicle Code to guide his investigations for traffic incidents. Therefore, in his view there was no crime, no assault and battery no illegal leaving of the scene.
He advised that I could submit further information to the incident report but that it was not going any further.

Incident Description

I was riding down Titan Road on my bicycle and was eastbound in the roundabout when this driver looked right at me, and then pulled out right in front of me requiring me to lock up my brakes. I was doing about 20mph and skidded to a near stop, but I am experienced enough to have handled the situation. I fear a less experienced rider could easily have either swerved into the other lane, crashed, or hit his truck. He then proceeded to flip me off when I yelled at him. Not only was this dangerous, but obviously intentional.

I have the video of this action here. I am also enclosing a photo of his truck with his license plate FED-717 (it may be FEO-717 but I believe it is FED) clearly visible. I got a good look at the driver like I said he looked right at me before pulling out, and he was older, maybe 50s or early 60s, had graying brown hair and a beard. He appeared to be dressed in clothes you might see a construction worker wearing. I believe if necessary I could identify him.

November 21, 2019 at 6PM. 280 south, before the Guadalupe Pkwy exit 3A, and Bird AVE exit 3B

I was split-laning in rush hour traffic. Cars were going about 30 mph, and I was going about 40 mph. A red SUV in the second from the left lane did a very abrupt, sudden, and aggressive lane change without using his turn signal. I was only a few feet behind his vehicle, and immediately hit my brakes, but he still side swiped me, knocking me off my bike. The point of contact was the panels around his driver's side rear wheel. After I was done sliding, I got up to pick up my bike. The driver who hit me pulled over in the distance, perhaps around 100ft away. An Asian woman got out of her vehicle to help me pick up by bike. She left immediately after we got my bike to the shoulder. The driver (middle aged Asian man) came over and acted very nice and friendly, and apologetic. We traded information and I was reassured that this situation would be taken care of. I evaluated my injuries, which was a minor limp, and aching, and due to the fact that the other driver was cooperative, I did not call the police. I had to reattach my right turn signal to my motorcycle, so I started working on it on the side of the road. The man stayed and helped me for 15+ minutes. During this time, he said his son was in his car. About 5 minutes after the initial incident, a man drove by and heckled him as he drove past. He yelled something in the lines of "You got into another accident!". The man said that was his co-worker. My bike took a lot of cosmetic damage, needs new plastics and fairings and has some dents and scratches, the rear frame might be bent. But it was in working condition so I rode off.
I notified my insurance immediately. Then a week later, they tell me that he did not notify his insurance so I had to do it. A week after that, his insurance reveals that he lied and said I merged into him. I have no witnesses, or have a helmet cam, so I have no evidence. I only have a few pictures of the damages to his vehicle. I don't have insurance coverage for my own damages.

I'm looking for anyone who could be a witness to this incident.

Incident Description

I was riding in a group with those mentioned above. We were northbound on Albion, approaching Olive Hill. Shaun was somewhat out in the road. The white car came up behind and honked. I yelled at Shaun to get out of the way. The driver had to slow slightly but passed with no other issue as Shaun pulled to the right. The car stopped at the intersection and a woman got out of the car, saying "you need to be riding single file". I replied that we do not and rode around her and turned right on Olive Hill. Millo tried to speak with her, but she quickly got back into her car and turned right, passing me with far less than three feet of clearance.

Mark and I were Northbound on Portola Road about 35 yards in front of the rest of our group signaling to make a left turn from Portola Road onto Portola Road (Sand Hill appears to be a continuation of the first part of Portola Road and continuing on the second part of Portola Road requires a left turn). Millo was taking up a protective position near the rear of the rest of the group, also signaling a left turn.
The driver passed the rear part of the group, around Millo's signaling arm and crossing over the double yellow (poor condition) centerline. The driver was continually blowing the car horn while passing.
She then passed Mark and me on the right as we were making the left turn.

Driver was making a U turn after two other cars turning left and did not look just made the U turn. Came within 2 inches of hitting me luckily I stopped in time. He didn't even notice that he almost hit me did not brake or slow down. Bystanders on street screamed in shock.

White Honda passed with less than 3" between car and bike. Likely near only 1 foot. Most drivers leave =/>3 feet. The white Honda may have been less than 2 feet in order to squeeze between me and the oncoming car. My rear view mirror allowed me to know the Honda was coming.

All the drivers passing were doing it illegally by crossing over the double line. Speed limit is 30 and 35 mph along the 0.8 mile stretch of road.

A couple of us who ride Tice Valley Blvd are working on getting Walnut Creek to paint the share the road signs and put yellow traffic signs showing bike/car 3" distance on posts.

Incident Description

As I gained speed, I moved into car lane to avoid hazards of parked car doors and cross traffic at high speeds. I was moving at the "normal speed of traffic" since I was travelling at 35-37 mph in a 35 mph zone. Then I hear a horn blasting as a gray 2009ish Dodge Journey passed closely. He laid on the horn long before he got to me until after he passed. When I caught him at the light at Seven Hills, he rolled down his window and yelled across his wife, "You got a fucking bike lane so use it". He is a 70 something Japanese man with gray hair. The woman is also gray haired and 70 something.

I was riding to the far right of the lane (essentially on the fog line.) There is no bike lane in this section. There is a shoulder with broken glass. The truck approached from behind at the same time that a car approached in the opposite direction. The truck driver sounded his horn. Afraid that he might hit me, I rode off the road onto the shoulder. From the video, you can see that the truck never moved over. Based on the lane width and the width of the truck, he clearly did not give me the 3 feet of clearance the law dictates.
These hauling trucks have been under scrutiny by the Castro Valley community. EBMUD has promised that these trucks will drive carefully, not speed, and will obey the traffic laws. Someone needs to explain to this driver that sounding your horn to drive a bicyclist off the road is not the correct way to pass the cyclist.

May 14, 2019 - Black Dodge Charger passed within four to 10 inches at 99.5 to 103.5 mph in a 40 speed zone. HPD found the owner, but was unable to identify a driver. No case to bring to the DA. Witness spotted the same black Dodge Charger (47WV519) on July 10, 2019 aggressively driving on I-565, eventually exiting at the same exit as complainant. Witness followed Charger as it sped over 50 mph on surface streets to eventually park at 615 Greenfield Drive NW.

The driver is a black male, age 35-50.

Also, driver is still driving around like an asshole even with direct video evidence of felony reckless endangerment. What the fuck is up with that?
